Hi!
Hi folks!

I thought I'd give you an update on what's going on with the servers and the ToS and all that fun stuff.

First things first - I am moving to a company (dedicated server) in Canada so that I have only one country's laws to deal with. This does not mean that people in other countries, while using the service, do not have to abide by their own laws, they do. But it means that for me, I have one set of laws to abide by rather than two.

I have selected a company and will be moving there shortly. I made a specific point to ask what their stance on fanfiction and fanart was. Here is a snippet of that correspondence. (The relevant bits)

The email I sent:

...I would like some clarification with regards to one part of your AUP:

You may not use your dedicated rack or virtual site to publish material, which [companyname] determines, at its sole discretion, to be unlawful, indecent or objectionable. For purposes of this policy, "material" refers to all forms of communications including narrative descriptions, graphics (including photographs, illustrations, images, drawings, and logos), executable programs, video recordings, and audio recordings.

Where it mentions illustrations, images, and drawings, I am mostly concerned about the affect this would have on my users being able to post "fanart". What generally falls under the category of objectionable and would art or fiction that doesn't depict or represent a real person (ie fictional characters) so long as it was not exploitative be acceptable?

I realize this can be a sticky situation and want to be as upfront as I can with anyone I will potentially be doing business with so that the transactions run smoothly and we have a good working/business relationship.


Their response:

Thank you for taking the time to contact us regarding our AUP. I can let you know we will not have a problem with what you will be hosting. The most important part is copyright infringement and illegal content and this has nothing to do with you.


I am satisfied with this response and the company has a very good reputation from what information I can find and reviews I have read.

Now to answer some more questions that have been posed or may be posed by this post!

1) If you're 18+ aren't you just like JournalFen now?
No. And there are quite a few differences you need to be aware of. JournalFen is by fans for fans - seriously. Scribblit is for anyone (who is 18+) who wants to use the service. Also you don't have to pay to have an account, accounts are free but there are paid features.

Many of the beta testers have accounts at JournalFen (and I do too) and they will tell you that the feel of the community is quite different.

2) I'm really disappointed that it's 18+ now. *humph*
I'm sorry that you're disappointed but that's the way it's going to be. The Canadian Criminal Code defines a minor as any person under the age of 18. That being said, hosting content that could potentially be considered inappropriate for those under 18 puts me at a liability. Yes, I am doing this to "cover my ass" but doing so protects me, the site AND its users. I cannot stress this enough: I am a real life person, spending hundreds of dollars of my own and of donations, working to get this up and running. I am not going to facilitate any activity that would make it easier for me to be sued, charged, put on trial and convicted.

3) I don't trust you now because of this
That's your prerogative to do so however I ask that you keep your comments civil and that you don't spread falsehoods. I have been 100% open, honest and upfront about every aspect of this endeavor and if that isn't enough to earn your trust then that is something I will have to accept and I will ask that you simply not stick around. Getting this up and running is stressful enough, I do not need the drama.

And remember, you're not under 18 forever.

And one final thought - a number of people have expressed an interest in making donations to the cause (so to speak) and I am extremely grateful for that. I have set up a paypal account (which I needed to do anyway) and you can use this button to make a donation if you so choose. You will notice that the money is being sent to info@twocorpses.net - I already owned the domain twocorpses.net and had not decided what to do with it so as of now, twocorpses.net is the "parent company" of Scribblit and that is why the email is such.

Best of luck with all this, I'm looking forward to seeing it up and running. And with regards to the 18+ clause, I for one can fully understand why you're doing it. It's not fair to expect you to run the risk of not putting the condition in place. So again, best of luck with this project. :)

I'm really looking forward to launch! I also think it's good you're doing 18+. I mean, honestly, it isn't hard to lie about your age (I was a pro at this, having started websites at Angelfire when I was 9), and it'll protect you, so...

Definitely applauding the server being moved to Canada. I trust Canada's government MUCH more than my own at this point.

I think you're making the right choice with both the hosting and the age requirement. While I can certainly sympathize with the teens--I was 15 when I delved into fandom--with the amount of "for the children" and "you can't do that on the internet" wank we've encountered over the last few years, it's just safer to be able to say "We do have an age policy in place."

Best of luck with this project. I'm certainly looking forward to the outcome.

Kudos to you for standing up for protecting yourself in all of this. I for one personally feel safer having the 18+ requirement.

Very happy to hear things are going along, as with 6A's latest post I've decided to quit LJ all together. Was looking forward to getting one just plain for writing and whatnot, but now.... *sighs* back to working on post and getting my LJ down to skeleton state, until hopefully I can have it all gone besides for the one post.

While you're working on the TOS for Scribblit might I suggest taking a look at Jiglu's as a good example.

While not all the rules they have would apply to a fandom friendly 18+ blogging site the plain English and amusing language makes them easy to understand. It might be worth emulating the style.

I definitely agree with the 18+ idea for Scribblit. It would make me feel better to know no one underage is on the site. That said, what's going to be your method of age verification? I don't want to have to enter my credit card number every time I log in, for example.

Way to go! One step closer, I think. Once my cell bill goes through, I'll definitely be able to donate! I want to help in any way that I can, but at the moment it might be awhile. But I fully intend to donate~ =DDD Keep up the good work, honestly, and kudos for keeping the 18+ rule and not bending to the dissatisfaction and negative comments of other users. ♥♥

Hi! I'm definitely very interested in your service and plan on opening an account there.

However, I have one question, and though it's not really important in the scheme of things, nor will your response affect my descision to come hang at scribblit, but I was wondering...

Will you allow multiple account creation? And I mean people who register forty or fifty different usernames just to have them, not just people with a single photo journal or the like.
What is your stance on the roleplaying community - for example, greatestjournal hosts many roleplaying users and as a result thousands of journals are created and barely to never used.
And finally, how often would you be planning on purging deleted usernames, if that is possible, and would you purge or redistribute usernames which have been inactive for three years and have never been posted to, checked or even logged in to?

These are kind of silly questions next to the epic importance of issues such as legal rights and the presence of minors on the site, but I am really just curious. There are people out there who come to new journal sites simply to have the newest and the best usernames with no intention of using them. Not that there's anything wrong with that, but it can annoy and upset people (especially if a well-known fandom 'nick' is claimed) and I was just wondering if you knew about it and/or had an opinion?

I'm sure you're too busy to worry about this right now, but I would be curious to see a cost list of everything you're doing. A lot of people are more willing to donate when they know what the money is going to and how much is being spent to make this fabulous thing.

As always I'm following your project with great interest, but I do have a question/concern regarding the decision to move the servers to Canada.

While browsing the comments to this article I found some references about Canadian law being more restrictive when it comes to depictions of fictional child pornography (hate the phrasing, but it seems like the clearest way to put it). I checked out the Wikipedia entry the commenter was referring to, and this is what I found.

Now, I'm both a)European and b)not a lawyer, and I realise Wikipedia is not the definitive source for info. Nevertheless, even to my inexpert judgement, this seems worrying. Do you know anything about this, and are you planning to consult with a lawyer before giving the project a green light?
